The Centre for New Zealand Music Trust (known as SOUNZ) provides a service that allows Customers to locate information and music on the SOUNZ website. This includes purchasing through e-commerce and delivery by download, as well as being able to place orders for library items.
Please note: All services provided and sales are subject to the copyright and other intellectual property interests of composers and other copyright and intellectual property owners.
If you receive damaged or defective merchandise, we will provide a replacement upon its return. If the item is no longer available we will issue a credit or exchange the item. We cannot exchange items, or accept returns for reasons other than if they are damaged or faulty. Choose carefully as we do not refund or exchange if you change your mind. If your purchase is in New Zealand and not for business purposes SOUNZ will meet its obligations under the Consumer Guarantees Act 1993. All goods are priced in New Zealand dollars. For New Zealand delivery addresses, all prices are GST inclusive unless otherwise stated.
SOUNZ accepts the following credit cards: Visa and MasterCard.
If a credit card company is used for a purchase, SOUNZ may obtain pre-approval from that company for an amount up to the amount of the purchase including freight costs. Billing to your credit card will occur at the time of purchase or soon thereafter.
i) Credit cards have daily limits that may stop the processing of your order.
ii) If a purchase is declined online, please ensure all details are correct and then re-submit.
Delivery by Download
Prior to purchasing a score or mp3 from the SOUNZ website, you must agree to the following terms and conditions:
This score/mp3 has been made from a digital file provided by SOUNZ and has been obtained through an authorised download. No part of this score/mp3 may be reproduced, stored in a retrieval system, or transmitted in any form or by any means, electronic, mechanical, copying, recording or otherwise, without the prior permission of the Centre for New Zealand Music Trust or the appropriate copyright holder.
Within New Zealand all goods are sent by standard post and have delivery times of 2-5 days. You can choose to have your goods sent by courier. We aim to have couriered goods delivered within 24 hours of despatch. International orders are sent by airmail. Delivery times vary depending on country of destination with 5-7 business days being the average.
SOUNZ makes every effort to ensure that delivery timeframes given are accurate. By placing an order, you agree not to hold SOUNZ liable for any loss or damage directly or indirectly arising out of or in connection with any delay or failure to deliver within the estimated time frame.
Posting and Addresses
If SOUNZ has misaddressed a product then SOUNZ will be responsible for the re-delivery, replacement or refunding of the product. If you have given an incorrect or insufficient address, SOUNZ will not refund or resend the product and you will bear all responsibility for correcting the delivery. For this reason, we encourage you to supply post codes with their address details.
SOUNZ understands and empathises with personal privacy concerns that affect users of the internet and email.
Please be assured we will not give your contact details to anyone else. We will use them to keep in contact with you within the course of our normal business and to provide the types of information that you choose to receive. You may, at any time, request to see the contact information that we have for you. You may also, at any time, request that we withdraw your contact information from our database. Under no circumstances will we sell, rent or give your private information including name, address, email to third parties.
We always provide a means by which you may choose to unsubscribe from communications. Individual users are not identified in Website statistics. These statistics are used to improve the site and monitor traffic.

SOUNZ grants you permission to access, view and download the content appearing on this site, for personal, non-commercial use only. You agree not to use any device, method or software to interfere with the proper functioning of this site. Without the express written permission of SOUNZ you may not use any device, method or software including, but not limited to: spiders, robots, avatars, agents, data mining, gathering or extraction tools and attempts to probe, scan or test or breach security and authentication measures.
The copyright in much of the material referred to and included on the SOUNZ website belongs to third parties such as composers, publishers or recording companies. The Centre for New Zealand Music has contracted various licences and other arrangements with these copyright owners. This allows us to disseminate their materials and information about them on the SOUNZ website and through other SOUNZ services
You agree not to modify or alter the content in any way, or make it available to any third parties without the permission of the Centre for New Zealand Music Trust and copyright owners.
SOUNZ Copyright and Trade Marks
You agree that the content you access, view or download and the software used to create it, remains the property of the Centre for New Zealand Music Trust as defined by New Zealand and International Intellectual Property Laws, including but not limited to Copyright and Trade Mark laws.
The SOUNZ website and the Intellectual Property Rights in the website shall at all times remain the exclusive legal, beneficial and equitable property of the Centre for New Zealand Music Trust and/or its successors, assignees and
licensees. Any and all rights not expressly granted under these Terms and Conditions are and remain reserved by the Centre for New Zealand Music Trust.
You agree not to modify or alter the content in any way, or make it available to any third parties without the permission of the Centre for New Zealand Music Trust.
Exclusion of Liability
SOUNZ shall not be responsible or liable in any way for any error, deletion, omission, defect, interruption or delay in operation, communications failure, theft, destruction or unauthorised use of the SOUNZ website or for any technical problem relating to communications networks, lines, systems,servers or providers, including damage to any computer or other equipment involved with accessing the SOUNZ website.
SOUNZ shall in no way be responsible or liable to you or any third party for damages of any nature whatsoever arising from your use of the SOUNZ website.
SOUNZ provision of services under this Agreement is provided on an “as is” basis and is strictly without any claim as to warrant of fitness or suitability for any particular purpose. The Centre for New Zealand Music is not able to provide any guarantee of specific results or performance based on use of the SOUNZ website.
SOUNZ shall not be responsible or liable in any way for the breach of any party’s intellectual property rights arising as a result of the integration of the SOUNZ website with any software, hardware or other material where such breach would not have occurred but for such integration.
Right to modify without notice
The Centre for New Zealand Music reserves the right to modify the terms and conditions of this Agreement at any time and without notice. Accessing this site constitutes agreement to the modified conditions. You are accordingly advised to review this Agreement regularly.
No failure or delay by the Centre for New Zealand Music relating to the exercise of any right, power, privilege or remedy provided by this Agreement to a breach of any term of this Agreement shall operate as a waiver of any other or subsequent breach.
If any provision of this Agreement is prohibited or held by a Court of proper jurisdiction to be unlawful, void or unenforceable then such provision shall to the extent required be severed from this Agreement without modifying or altering the remaining provisions. Such severance shall not in any way affect the validity or enforcement of those remaining provisions.
Clause headings are included for ease of reference only and shall not affect the construction of this Agreement.
New Zealand Law
This Agreement and all sales and services of the Centre for New Zealand Music shall be construed in accordance with the laws of New Zealand.
Any dispute arising under this Agreement will be determined in New Zealand by a court or tribunal with proper jurisdiction.
